MGI Tech GmbH, an entity under MGI Tech, is aware of the preliminary injunction issued by the Unified Patent Court (UPC), Munich Local Division, relating to CycloneSEQ sequencers and flow cells in selected European countries. We respectfully but firmly disagree with this decision and wish to clarify our position:
1. The preliminary injunction is a temporary measure, not a final or permanent injunction. And it is limited to the specific products and identified European markets as set out in the decision; it does not affect MGI Tech’s broader business operations or product portfolio.
2. The preliminary injunction was granted in expedited provisional measures proceedings. We believe it is unjustified and does not reflect the full legal and technical merits of the case. We will immediately file an appeal with the UPC Court of Appeal and defend our position vigorously.
3. CycloneSEQ-related products are the result of our own significant research and development investments. We are committed to competing fairly and lawfully in the European market. We assure our commitment to resolving this matter lawfully.
